20 New Bills Boost Voting Transparency

The Governor has approved 20 new bills focused on improving election laws and procedures to ensure free and fair voting practices. These laws aim to enhance transparency, protect voter integrity, and clarify existing election-related processes.

“South Dakota continues to be an example of free and fair elections. Our election system has integrity, and these bills improve our already strong system,” said Governor Larry Rhoden. “America is founded on the principle of freedom, and I am proud that we live in a nation and a state where we can choose our leaders.”

However, one bill, House Bill 1169, was vetoed. In a letter to lawmakers, the Governor explained that while the bill's goal of safeguarding the process for adding constitutional amendments is valid, the approach it proposed—changing the constitution through a statute—raises legal concerns.

“This bill has a worthy goal: placing safeguards on the process to add constitutional amendments to the ballot in South Dakota,” said Governor Rhoden. “However, I am concerned that this bill will not withstand scrutiny in the courts. This bill attempts to change the South Dakota Constitution in statute, and I believe that approach to be misguided.”

Among the 20 bills signed into law are several key changes:

  • SB 68 and SB 75 require proof of U.S. citizenship to vote and indicate citizenship status on state IDs.
  • SB 73 and HB 1066 clarify residency requirements for voter registration.
  • SB 164 introduces penalties for using deepfake technology to manipulate elections.
  • SB 173 and HB 1126 revise recount procedures and board compensation.
  • HB 1062 enhances the maintenance of the voter registration file.
  • HB 1208 restricts the use of mail forwarding addresses for in-state voting, classifying such voters as federal voters.
  • HB 1256 and HB 1264 increase transparency by requiring more detailed information on petitions and campaign finance reports.

Other bills refine timelines and requirements for ballot measures, voter eligibility, and public notification of election procedures.

With these new additions, the Governor has now signed 177 bills into law and vetoed two during this legislative session. These efforts collectively aim to uphold election integrity while ensuring that voter participation remains strong and secure.
