Diverse Coalition Challenges Eminent Domain Use

South Dakota witnesses the rise of a powerful alliance, South Dakotans First, as they boldly step into the spotlight. This coalition, a blend of agricultural bodies and landowners, announced at a recent press conference their commitment to tightening controls on eminent domain applications, specifically targeting carbon dioxide pipeline constructions.

Central to their concern is the Summit Carbon Solutions’ ambitious multi-state carbon dioxide pipeline project. Despite Summit's withdrawal of eminent domain proceedings, the coalition remains vigilant. They assert that private land shouldn't be so easily accessible for projects, particularly those like Summit's pipeline, which they argue doesn't serve the public in a direct way.

Doug Sombke, at the helm of the Farmers Union, emphasizes the necessity of redefining "public use." The coalition questions the public utility of burying carbon underground, despite acknowledging the broader environmental benefits.

The legislative arena is heating up as well. Representatives like Karla Lems are not just spectators but also potential affected landowners. They're pushing for laws barring eminent domain usage until companies secure necessary permits. This comes as Summit readies to reapply for their construction permit, having faced initial rejection due to non-compliance with local regulations.

The coalition isn't without substantial public support. A survey they commissioned indicated a strong opposition among voters against using eminent domain for private projects. Summit, however, counters with their aim of achieving full voluntary cooperation from landowners and underscores the project's benefits for local farmers.

As the legislative session looms, lawmakers express that the coming debates will transcend partisan lines, focusing instead on protecting individual rights versus corporate interests. The coalition's efforts also extend support to those contesting a proposed state prison location. This united front signals a burgeoning resistance against unchecked eminent domain, spotlighting the tug-of-war between private rights and public interests.
